3. Offer and Contract Conclusion

The presentation of products in our online shop does not constitute a legally binding offer to conclude a purchase agreement, but rather a request to submit an order.

By submitting an order through the online shop, the customer makes a binding offer to purchase the selected goods.

Before submitting the order, the customer can review the entered data and selected products and correct them if necessary.

The contract is concluded when we accept the order through an express order confirmation by email or when we ship the goods to the customer.

The automatically sent order receipt does not generally constitute acceptance of the contract offer unless it expressly states acceptance.

4. Contract Language and Storage of Contract Terms

The language available for contract conclusion is English.

We store the contract terms after contract conclusion within the scope of legal provisions.

The specific order data can be provided to the customer together with the order confirmation or the corresponding order information.

The customer is responsible for keeping their order documents and the contract information sent to them.

5. Prices and Payment Terms

All prices stated in the online shop are in US dollars (USD).

The applicable prices are displayed on the product pages and during the checkout process.

The payment methods available at checkout are displayed to the customer before the order is completed.

Depending on availability, the following payment methods may be offered in particular:

  • Credit card or debit card

  • PayPal

  • Shop Pay

  • Apple Pay

  • Google Pay

  • Klarna

Only the payment methods that are actually displayed and offered in the respective checkout process apply.

Payment is generally due upon completion of the order, unless otherwise stated for the respective payment method.

If a payment fails or is rejected, the order cannot be processed until payment is successful.

6. Delivery and Shipping

We generally deliver within the United States.

Standard shipping within the United States is free of charge.

The standard processing time is up to 7 business days.

The carrier's transit time is additional to the processing time and depends on the carrier, shipping method and delivery address.

The stated delivery times apply unless otherwise specified on the respective product page.

Business days are Monday through Friday, excluding legal holidays at the shipping or delivery location.

Appropriate package and logistics service providers may be used for shipping depending on the order. The specific shipping service provider may vary depending on the product, delivery address, and shipping method.

If tracking is available for the respective shipment, the corresponding information can be provided after dispatch.

7. Delivery Delays and Partial Deliveries

If there is a delay, we will inform the customer to the extent possible.

For orders with multiple products, partial deliveries may occur if this is appropriate due to availability or logistical handling.

Partial deliveries arranged by us do not incur additional shipping costs for the customer.

If a product is unexpectedly unavailable, we will inform the customer and refund any payments made for non-deliverable goods in accordance with legal requirements.

8. Shipping Address

The goods will be shipped to the delivery address specified by the customer during the checkout process.

The customer is responsible for providing the delivery address correctly and completely.

If the delivery address is incorrect or incomplete, additional shipping or return costs may be incurred if the customer is responsible for the error.

The customer's statutory rights remain unaffected hereby.

9. Retention of Title

The goods remain our property until full payment of the respective purchase price.

For merchants, the retention of title additionally applies until full settlement of all claims arising from the ongoing business relationship, to the extent permitted by law.

10. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal if the legal requirements are met.

Details, in particular regarding the withdrawal period, the exercise of withdrawal, and the consequences of withdrawal, are contained in our separate withdrawal notice.

The statutory withdrawal period is generally 14 days.

The statutory right of withdrawal can be exercised via the designated contact options as well as via the legally required electronic withdrawal function.

The statutory right of withdrawal is not restricted by a voluntary return option we additionally offer.

11. Voluntary Return Option

In addition to the statutory right of withdrawal, we offer consumers a voluntary return option for up to 30 days after receipt of the goods.

The conditions and details of this voluntary return option are described in our separate returns and refund policy.

The statutory consumer rights, in particular the statutory right of withdrawal and statutory warranty rights, remain unaffected hereby.

12. Warranty and Claims

The statutory provisions regarding warranty apply.

In case of defective goods, the customer has statutory rights, in particular to remedy, and – if the statutory requirements are met – to reduction of the purchase price or withdrawal from the contract, as well as possibly to damages.

For consumers, the statutory limitation periods apply.

An additional manufacturer's warranty exists only if it is expressly offered for the respective product. Such a warranty does not restrict the customer's statutory rights.

13. Transport Damage

We ask customers to check the delivered goods for obvious transport damage if possible immediately upon receipt.

Any identified damage can be reported to us as soon as possible.

Failure to report transport damage has no impact on consumers' statutory warranty rights.

14. Liability

We are liable in accordance with statutory provisions for damages arising from injury to life, body, or health.

Beyond this, we are liable without limitation for intent and gross negligence as well as in legally mandatory cases.

In case of slight negligence in breach of material contractual obligations, our liability is limited to foreseeable, contract-typical damages.

Otherwise, liability for slight negligent breaches of duty is excluded to the extent permitted by law.

The liability limitations do not apply where mandatory statutory liability provisions preclude them.

15. Consumer Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer mediation body unless there is a legal obligation to do so.

The statutory information obligations regarding consumer dispute resolution remain unaffected.

Further information can be found on our consumer dispute resolution page.

16. Applicable Law

All contractual relationships are governed by the law of the Federal Republic of Germany excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

17. Jurisdiction

For consumers, the statutory jurisdiction rules apply.

For merchants, legal entities under public law, or public assets – to the extent permitted by law – the jurisdiction for all disputes arising from contractual relationships is our place of business in Pommersfelden.

18. Severability Clause

Should any provision of these Terms and Conditions be or become wholly or partially invalid, the remaining provisions shall remain unaffected.

The statutory provisions shall apply in place of the invalid provision where they exist.
